As of April 1, 2025, surrogacy is fully legal in Michigan under the Assisted Reproduction and Surrogacy Parentage Act (Michigan Family Protection Act), which decriminalized both compensated and altruistic gestational surrogacy arrangements. This landmark legislation repealed a 1988 ban that had made Michigan the only state to criminalize paid surrogacy contracts, previously carrying penalties up to a year in jail and a $10,000 fine.
Under the new law, intended parents—regardless of marital status, gender, or sexual orientation can establish legal parentage through a pre-birth court order, eliminating the need for post-birth adoption. Gestational carriers must be at least 21 years old, have previously given birth, complete medical and psychological screenings, and retain independent legal representation.
This reform provides a clear and supportive legal framework for surrogacy in Michigan, offering protections for all parties involved and facilitating family-building options for residents and those seeking surrogacy services in the state.
